Terms of Service

These terms cover Jinya: the website at jinya.app, the Jinya logger and Jinya's Discord bot (together, "Jinya"). Jinya is run by KarmaPanda in New York, United States ("we"). By using Jinya you agree to these terms and to the Privacy Policy. If you don't agree, don't use Jinya.

A fan project

Jinya is an independent tool for Black Desert Online players. It is not affiliated with, endorsed by or sponsored by Pearl Abyss. Black Desert, its names, images and other game content belong to Pearl Abyss and are used here as fan content.

Who can use Jinya

You must be at least 13, and old enough to agree to these terms where you live. You use Jinya on your own behalf, or for a guild you're allowed to act for.

Your account

• Give accurate information and keep your sign-in details and recorder keys to yourself. You're responsible for what happens under your account.
• Tell us at [email protected] if you think someone else is using your account.
• Owners and officers are responsible for how they run their guild on Jinya: who they let in, the roles they give, and the settings they choose.

The logger and the game

The logger reads your computer's network traffic, through Npcap, to see what the game shows you during a war. It doesn't change the game, its files or its traffic. Npcap is a separate program with its own license, installed from its maker. You are responsible for following Black Desert's own terms and rules; we can't promise that Pearl Abyss, or any game publisher, approves of tools like this one, and you use the logger at your own risk.

We license the logger to you for personal use with Jinya. Don't resell it, or use it to break the game's rules or anyone else's rights.

What you upload

You keep the rights you have in what you upload (recordings, imported logs, notes and settings). You give us permission to store, process, combine and show it as Jinya works: on war pages as their visibility allows, merged with other recordings of the same war, and in public statistics as your guild's and players' sharing choices allow. This permission ends when the content is deleted, except for backups (kept for up to 8 weeks) and statistics already combined from many wars.

Only upload what you're allowed to share. Recordings name other players as the game shows them; treat that respectfully.

Acceptable use

Don't use Jinya to:

• Harass, threaten or dox anyone, or post hateful or illegal content (for example in war or guild names);
• Upload made-up or tampered wars, or pass off another guild's wars as your own;
• Get into accounts, guilds or wars you're not allowed in, or get around a limit or security measure;
• Overload, scrape or attack Jinya, or interfere with other people's use of it;
• Break the law or anyone's rights.

We may remove content, or suspend or close accounts and guilds, that break these terms.

Plans and payments

Jinya is free to use today. Paid plans aren't on sale yet; when they are, their price, billing and refund terms will be shown before you buy, and will apply on top of these terms.

Other services

Jinya works with services we don't control, such as Discord, Garmoth, Black Desert profile data and the tools you export to. Their own terms apply to them, and we're not responsible for them.

Availability and changes

We work to keep Jinya running and accurate, but it is provided as is and as available. Game patches can stop recording for a while, numbers read from the game can be wrong, and features can change or end. To the fullest extent the law allows, we make no warranties, express or implied, including fitness for a particular purpose and non-infringement.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data, in-game losses or account actions taken by a game publisher. Our total liability for any claim about Jinya is limited to the greater of what you paid us in the 12 months before the claim and 50 US dollars.

Ending

You can stop using Jinya at any time, and delete your account from your account page. We may suspend or end your access if you break these terms or to protect Jinya or others. Sections that by their nature should continue (such as content permissions for backups, disclaimers, limits of liability and governing law) continue after that.

Changes to these terms

We may update these terms. We'll change the date above and tell you on the site or by email for important changes. Using Jinya after a change means you accept it.

Governing law

These terms are governed by the laws of the State of New York and of the United States, without regard to conflict of law rules. Disputes go to the state or federal courts in New York, unless the law where you live gives you the right to bring them elsewhere.
